1. Scope
(1) These GTC apply to all contracts concluded via the online shop at shop announcement and to all other use of https://www.bernd-armaturenbau.de.
(2) The offer is primarily aimed at businesses (§ 14 BGB). Consumers (§ 13 BGB) may also order; consumer protection rules under these GTC apply additionally.
(3) Deviating customer terms apply only if expressly confirmed in writing.

3. Subject matter
Bernd Armaturenbau GmbH supplies fittings, adapters, hoses and accessories for hydraulic and industrial applications. The online shop enables purchase of standard and custom products.
4. Registration and customer account
(1) Orders may be placed after registration via a customer account or as a guest.
(2) Registration data must be complete and truthful.
(3) The customer must keep login credentials confidential and not allow unauthorised access.
5. Conclusion of contract
(1) Product display in the shop is an invitation to order, not a binding offer.
(2) Completing the order process constitutes a binding offer by the customer.
(3) The contract is formed by written or electronic order confirmation.
(4) For consumers, a contract is only formed when Bernd Armaturenbau GmbH expressly accepts the order or ships the goods.
(5) For businesses, offers are non-binding; changes remain reserved.
6. Prices and payment
(1) Unless stated otherwise, all prices are in euros plus statutory VAT. Consumer prices include VAT where shown.
(2) Payment methods: prepayment, invoice (B2B), PayPal, credit card. If prepayment is selected, delivery follows after receipt of payment.
(3) In case of default, Bernd Armaturenbau GmbH may charge statutory default interest.
7. Delivery and shipping
(1) Delivery is via UPS or by collection as agreed.
(2) Delivery times are indicated in the shop.
(3) For businesses, risk passes to the carrier upon handover.
(4) Partial deliveries are permitted if reasonable for the customer.
8. Retention of title
Goods remain the property of Bernd Armaturenbau GmbH until paid in full. For businesses, retention of title extends until all claims from the ongoing business relationship are settled.
9. Right of withdrawal (consumers only)
(1) Consumers have a statutory right of withdrawal under §§ 355 ff. BGB.
(2) There is no right of withdrawal for goods not prefabricated and whose manufacture depends on an individual choice or specification by the consumer, or which are clearly tailored to personal needs (§ 312g (2) No. 1 BGB).
(3) Full withdrawal information including a model form is provided in the checkout process and under “Right of withdrawal” on the website.
10. Warranty and liability
(1) Statutory warranty rights apply to consumers.
(2) For businesses:
a) defect claims expire 12 months after delivery.
b) The customer must inspect goods immediately and notify obvious defects in writing without delay (§ 377 HGB).
(3) Liability: Bernd Armaturenbau GmbH is liable for intent and gross negligence. For ordinary negligence, only for damage from injury to life, body or health and for breach of material contractual obligations; in the latter case liability is limited to typical, foreseeable damage.
(4) Product specifications are binding only if expressly confirmed in writing.
11. Privacy
(1) Personal data is processed only as described in the privacy policy on this website.
(2) The customer must use data only for the intended purpose and not circumvent security measures.
12. Intellectual property / rights of use
All content on the website, in particular texts, images, graphics and product descriptions, is protected by copyright or other rights of Bernd Armaturenbau GmbH or third parties.
Reproduction, modification or other use requires prior consent.
13. Online dispute resolution
(1) The EU Commission provides a platform for online dispute resolution: https://ec.europa.eu/consumers/odr
(2) Bernd Armaturenbau GmbH is not obliged and not willing to participate in dispute resolution before a consumer arbitration board.
14. Applicable law and jurisdiction
(1) German law applies to the exclusion of the UN Convention on Contracts for the International Sale of Goods.
(2) For disputes with businesses, the place of jurisdiction is Siegburg.
(3) For consumers, statutory jurisdiction at their place of residence applies.
15. Final provisions
If individual provisions are or become invalid, the remaining provisions remain effective.
Amendments or supplements require written form.
